Report: Risky Analysis: Assessing and Improving AI Governance Tools

We are pleased to announce the publication of a new WPF report, “Risky Analysis: Assessing and Improving AI Governance Tools.” This report sets out a definition of AI governance tools, documents why and how these tools are critically important for trustworthy AI, and where these tools are around the world. The report also documents problems in some AI governance tools themselves, and suggests pathways to improve AI governance tools and create an evaluative environment to measure their effectiveness. AI systems should not be deployed without simultaneously evaluating the potential adverse impacts of such systems and mitigating their risks, and most of the world agrees about the need to take precautions against the threats posed. The specific tools and techniques that exist to evaluate and measure AI systems for their inclusiveness, fairness, explainability, privacy, safety and other trustworthiness issues — called in the report collectively AI governance tools – can improve such issues. While some AI governance tools provide reassurance to the public and to regulators, the tools too often lack meaningful oversight and quality assessments. Incomplete or ineffective AI governance tools can create a false sense of confidence, cause unintended problems, and generally undermine the promise of AI systems. The report contains rich background details, use cases, potential solutions to the problems discussed in the report, and a global index of AI Governance Tools.

WPF urges National Science Foundation to study Statistical Parity

The World Privacy Forum submitted public comments today to the National Science Foundation in response to its request for information about a national privacy research strategy. WPF urged a research focus on statistical parity and its implementation. Statistical parity is a term WPF's Pam Dixon coined at the FTC’s Big Data, Tool For Inclusion or Exclusion? workshop in September 2014. Here is Dixon's definition of the term:

India Update: Talk, National Law University, New Delhi India

I was honored to address students at the National Law University, Delhi this past week about privacy in the US and global privacy trends and issues. The talk included a Q and A session, during which the students engaged in a spirited conversation about US policies regarding surveillance and privacy. I enjoyed the session thoroughly. The students asked challenging questions in particular about telecommunications policies and the idea of safety versus privacy and achieving proper balance.

Reputation and privacy -- Pam Dixon spoke at the Southwestern Law School Privacy Conference on the topic of reputational privacy Friday the 22cnd along with Neville Johnson and Paul Tweed. Dixon highlighted three key consumer situations WPF assisted with recently, discussing the employment challenges consumers faced when harmful material was available online during the job search process.

NTIA drafting process ongoing

Mobile Privacy -- The World Privacy Forum attended the NTIA Multistakeholder meeting as one of the core drafters of the code of conduct being considered by the NTIA Multistakeholder process. WPF and the other drafters are accepting comments from all stakeholders in preparation of the next iteration of the draft.

Debating the future of privacy

Arizona School of Law -- Pam Dixon participated as a discussant and contributor to the Arizona School of Law's private workshop on the topic of the future of privacy. Key areas of discussion included the European Union's Right to be Forgotten proposal, consent and health privacy, and Do Not Track.

US Supreme Court delivers opinion about GPS tracking

01/23/2012 GPS tracking | United States v. Jones -- The US Supreme Court unanimously ruled that police must get a warrant before using GPS devices to track criminal suspects. This case was narrow and dealt specifically with a GPS device physically attached to a suspect's vehicle. The concurring opinion of Justice Sotomayor points out that the subtler issues of digital era tracking were not dealt with in this case, for example, cell phone tracking, web site tracking, etc. She wrote: "More fundamentally, it may be necessary to reconsider the premise that an individual has no reasonable expectation of privacy in information voluntarily disclosed to third parties. E.g., Smith, 442 U. S., at 742; United States v. Miller, 425 U. S. 435, 443 (1976)." She continued: "This approach is ill suited to the digital age, in which people reveal a great deal of information about themselves to third parties in the course of carrying out mundane tasks."

WPF comments about Personal Health Records and online advertising

Health privacy -- The World Privacy Forum filed comments today about how medical records and other health information is intersecting with online advertising and online activities. The WPF comments were filed with the Department of Health and Human Services in response to its request for comments on personal health records, privacy, and social media.

Good privacy decision in Amazon v. Lay fight to keep customer information private

Resource | case file -- Amazon.com filed a lawsuit in April to fight the North Carolina Department of Revenue's request for detailed information on Amazon.com customers. The North Carolina tax department requested Amazon.com to hand over "all information for all sales to customers with a North Carolina shipping address" between 2003 to 2010. In the decision, Seattle, Washington U.S. District Court Judge Marsha J. Pechman wrote, "Citizens are entitled to receive information and ideas through books, films, and other expressive materials anonymously." She also stated that "The fear of government tracking and censoring one\'s reading, listening, and viewing choices chills the exercise of First Amendment rights." This is an important decision for privacy rights, and online privacy in particular.

WPF files two sets of key comments on HIPAA privacy rule

Health privacy and HIPAA -- The World Privacy Forum filed two sets of detailed regulatory comments on recently proposed changes to HIPAA. The first comments focused on proposed changes to HIPAA in the area of marketing patient information. The proposed changes would be harmful to patient privacy, and are contrary to the law. WPF was joined in the marketing comments by the Center for Digital Democracy, Consumer Action, Consumer Federation of America, the Electronic Frontier Foundation, Privacy Activism, Privacy Rights Clearinghouse, and Privacy Times. The second set of comments WPF filed included the comments on marketing as well as on additional provisions that would be problematic if enacted.
